These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and Viathorn ("Company," "we," "our," or "us") governing the rental of luxury vehicles and related services. By accessing our website or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. DEFINITIONS
For purposes of these Terms:
- "Service" refers to all vehicle rental offerings, delivery services, route guidance, and related amenities provided by Viathorn
- "Vehicle" means any automobile made available for rental under these Terms
- "Rental Period" is the agreed timeframe from vehicle pickup to return, as specified in the Rental Agreement
- "Rental Agreement" is the written contract document confirming specific rental terms for each booking
- "Authorized Driver" is any person designated in the Rental Agreement and meeting our driver requirements
- "Damage" includes any physical, mechanical, or cosmetic impairment to the Vehicle
2. ACCEPTANCE OF TERMS
Agreement Formation
A binding rental agreement is formed when:
- We accept your reservation request through written confirmation
- You sign the Rental Agreement document
- Payment is processed and confirmed
- You take possession of the Vehicle
Eligibility Requirements
To enter into this agreement, you must:
- Be at least 25 years of age
- Hold a valid Singapore driving license or recognized international driving permit
- Have at least three years of driving experience
- Possess legal capacity to enter into binding contracts under Singapore law
- Provide valid identification (NRIC, passport, or approved equivalent)
3. RENTAL SERVICES
Service Offerings
Viathorn provides three primary rental structures:
- Structure Drive Daily: 24-hour vehicle rental with delivery service and route guidance
- Power Touring Pair: Weekend rental of two vehicles with comparative briefing
- Architectural Tour Fleet: Guided architectural tour with professional driver
Service Availability
Services are available:
- Within Singapore geographical boundaries only
- Subject to vehicle availability at time of confirmed booking
- During operating hours: Monday through Sunday, 09:00 to 21:00
- With advance notice (minimum 48 hours recommended)
Vehicle Selection
While we accommodate preference requests, we cannot guarantee specific vehicle makes or models. Vehicles are selected based on availability within the requested design category. All vehicles meet our quality and maintenance standards regardless of specific manufacturer.
4. CLIENT RESPONSIBILITIES
Proper Vehicle Use
Clients must:
- Operate the Vehicle in accordance with Singapore traffic laws and regulations
- Use the Vehicle only for lawful purposes
- Maintain the Vehicle in good condition throughout the Rental Period
- Refuel to the same level provided at handover
- Report any mechanical issues or incidents immediately
- Return the Vehicle at the agreed time and location
Prohibited Activities
The following are strictly prohibited:
- Operating the Vehicle while under the influence of alcohol or controlled substances
- Allowing unauthorized persons to drive the Vehicle
- Using the Vehicle for racing, competitive driving, or timed speed trials
- Transporting illegal goods or substances
- Smoking or vaping inside the Vehicle
- Transporting pets without prior written authorization
- Off-road driving or operation on unsuitable surfaces
- Overloading the Vehicle beyond manufacturer specifications
- Removing or tampering with vehicle identification or tracking systems
Vehicle Inspection
Clients are responsible for:
- Conducting thorough pre-rental inspection with our specialist
- Reporting any pre-existing damage or concerns before departure
- Documenting Vehicle condition at pickup
- Returning the Vehicle in the same condition as received (normal wear excepted)
5. PAYMENT TERMS
Pricing and Fees
Rental rates include:
- Vehicle rental for the agreed period
- Comprehensive insurance coverage
- Delivery and collection within Singapore
- Route guide materials and briefing
- 24-hour roadside assistance
- All applicable taxes (GST)
Payment Methods
We accept the following payment methods:
- Major credit cards (Visa, Mastercard, American Express)
- Bank transfer (for advance bookings)
- Corporate accounts (subject to approved credit terms)
Security Deposit
A refundable security deposit is required:
- Amount varies by vehicle category (SGD 2,000 - 5,000)
- Held as credit card authorization or bank transfer
- Released within 14 days of rental completion (subject to inspection)
- May be applied to cover damage, late return, or traffic violations
Currency
All prices are quoted and payable in Singapore Dollars (SGD). Exchange rates for foreign currency payments are determined at time of transaction.
6. CANCELLATION AND REFUNDS
Client Cancellation
- More than 72 hours before pickup: Full refund
- 48-72 hours before pickup: 50% fee applied
- Less than 48 hours before pickup: 100% fee applied (no refund)
- Emergency situations: Evaluated case-by-case with documentation
Company Cancellation
Viathorn reserves the right to cancel reservations if:
- Vehicle becomes unavailable due to unforeseen circumstances
- Client fails to meet eligibility requirements
- Safety concerns arise regarding the rental
In such cases, full refund is provided or alternative vehicle offered.
7. INSURANCE AND LIABILITY
Included Coverage
All rentals include comprehensive insurance covering:
- Collision damage to the Vehicle
- Third-party liability as required by Singapore law
- Personal accident coverage for driver and passengers
- Theft protection
Client Liability
Clients are liable for:
- Damage resulting from prohibited use or negligence
- Traffic violations and parking fines incurred during rental
- Loss or damage to personal belongings left in Vehicle
- Key loss or remote control damage
- Interior damage including stains, burns, or excessive cleaning requirements
Excess and Deductibles
Insurance policies include standard excess amounts as detailed in the Rental Agreement. Clients are responsible for excess payments in the event of claims.
8. TERMINATION
Company Right to Terminate
We may terminate the rental immediately if:
- Client breaches these Terms or the Rental Agreement
- Vehicle is used for prohibited purposes
- Payment authorization fails or is declined
- Vehicle safety or security is compromised
- Client provides false information or documentation
Upon termination, Client must immediately return the Vehicle. No refund is provided for terminated rentals.
9. DISPUTE RESOLUTION
Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Singapore. Any disputes arising from or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Singapore.
Informal Resolution
Before initiating formal proceedings, parties agree to attempt good-faith resolution through direct negotiation. Contact our client services team at [email protected] to initiate dispute resolution.
Mediation
If informal resolution fails, parties may agree to mediation through the Singapore Mediation Centre before pursuing litigation.
10. LIMITATION OF LIABILITY
To the maximum extent permitted by Singapore law:
- Viathorn's total liability shall not exceed the total rental fees paid for the affected booking
- We are not liable for indirect, consequential, or incidental damages
- We are not responsible for personal injury resulting from Client negligence
- We are not liable for loss or damage to personal property left in Vehicles
- Service interruptions due to force majeure events are excluded from liability
This limitation does not affect liability that cannot be excluded or limited under Singapore law.
11. GENERAL PROVISIONS
Entire Agreement
These Terms, together with the specific Rental Agreement, constitute the entire agreement between parties and supersede all prior understandings or agreements.
Severability
If any provision is found invalid or unenforceable, remaining provisions continue in full force and effect.
Waiver
Failure to enforce any right or provision does not constitute a waiver of that right or provision.
Assignment
Clients may not assign or transfer rights or obligations under these Terms without our written consent. We may assign our rights and obligations to affiliated entities or service providers.
12. CHANGES TO TERMS
We reserve the right to modify these Terms at any time. Changes become effective:
- Upon posting updated Terms on our website
- 30 days after email notification to registered clients
- Immediately for changes required by law or regulation
Continued use of services after changes indicates acceptance of modified Terms. Existing reservations are governed by Terms in effect at booking time.
